1. Introduction

We respect your privacy and are committed to handling your personal information in accordance with the Australian Privacy Principles (APPs) under the Privacy Act 1988 (Cth) and applicable consumer protection laws, including the Australian Consumer Law (ACL). This Privacy Policy explains what information we collect, why we collect it, how we use it, and the choices you have.

By using Focusly, you agree to this Privacy Policy. If you do not agree, please discontinue use of our services.

2. Scope and who we are

Focusly is provided by Ezra Devs Pty Ltd (ACN pending), operating from New South Wales, Australia. Our services include a web application, API, and related support channels designed for students, educators, and parents/guardians. This policy applies to all users, including minors who use the service with appropriate consent.

3. Data we collect

We collect personal information that is reasonably necessary to provide our services:

  • Account data: name, email, password (hashed), school/subject preferences, subscription tier, verification status.
  • Service use: study goals, selected modules, saved outputs, folders, calendar events, help requests, activity logs, AI usage metrics.
  • User content: notes, documents, prompts, uploaded files (e.g., .pdf, .txt), and generated outputs you choose to store.
  • Payment & billing: transaction IDs, plan details, billing status, renewal/cancellation preferences. Payments are processed by third-party providers; we do not store full card details.
  • Device & technical: IP address, browser/device information, time zone, app version, diagnostics, and cookie identifiers.
  • Support: communications, tickets, and any information you provide when seeking help.

Avoid uploading sensitive information (e.g., health data). If you include it, you consent to our handling of that information for the purpose of providing the service.

4. How we use data

We use personal information to provide, maintain, and improve Focusly, including to:

  • Set up and manage accounts, authentication, and user preferences.
  • Deliver AI-powered study tools, generate outputs, and store your content securely.
  • Provide customer support, troubleshoot, and respond to requests.
  • Process subscriptions, free trials, invoicing, and apply concessions or offers.
  • Monitor performance, prevent fraud or misuse, enforce our Terms of Service, and maintain platform integrity.
  • Send service communications (e.g., verification emails, important notices). We only send marketing with your consent and you can opt out at any time.
  • Improve features through anonymised or aggregated analytics where possible.

5. AI and automated processing

Focusly uses third-party AI models (currently OpenAI) to generate study materials and feedback based on your prompts and uploads. We send only the data necessary to perform the requested task.

  • Content you submit may be processed by AI to generate outputs you request.
  • We disable model training on your data where the provider allows.
  • We log token usage for billing and abuse monitoring, but we minimise personal data in these logs.
  • Outputs may be inaccurate; do not rely on them as a sole source of academic, legal, medical, or financial advice.

6. When we share data

We do not sell your personal information. We share it only when necessary:

  • Service providers: hosting, analytics, email delivery, payment processors, and AI providers under confidentiality and data protection obligations.
  • Legal and safety: to comply with law, respond to lawful requests, protect rights, safety, or prevent fraud or abuse.
  • Business transfers: in connection with a merger, acquisition, or sale, where information remains subject to this policy.
  • With your direction: when you ask us to share data or link with third-party tools.

7. Security

We implement technical and organisational measures such as encryption in transit, access controls, environment segregation, and monitoring. No system is entirely secure; please keep your account credentials confidential and notify us promptly of any suspected compromise.

8. Cookies and tracking

We use cookies and similar technologies to authenticate sessions, remember preferences, and analyse usage to improve the service. You can adjust browser settings to refuse cookies, but some features may not work properly. We do not use cookies for third-party targeted advertising.

9. International transfers

Our providers may store or process data in Australia, the United States, the European Union, or other locations. We take reasonable steps to ensure overseas recipients handle personal information in a manner consistent with the APPs, including through contractual safeguards.

10. Retention

We keep personal information only as long as needed for the purposes described, to comply with legal obligations, resolve disputes, and enforce agreements. You may delete stored outputs and close your account; residual backups may persist for a limited period.

11. Your rights

Under the APPs you can request:

  • Access to the personal information we hold about you.
  • Corrections if information is inaccurate, out of date, incomplete, or misleading.
  • Withdrawal of consent where processing relies on consent (e.g., marketing).
  • Deletion of stored outputs or account closure, subject to legal retention requirements.

12. Children and young people

Focusly supports high school students, including minors. Students under 18 should use the service with consent from a parent, guardian, or school representative. We do not knowingly collect personal information from children under 13 without appropriate consent. If you believe a child has provided information without consent, please contact us and we will take reasonable steps to delete it.

13. Changes to this policy

We may update this Privacy Policy to reflect changes in law, our practices, or service features. We will post the updated version here and update the “Last updated” date. Material changes may be communicated by email or in-app notice.
